Mark S. Ashworth has been a full-time California trial attorney since 1978, trying civil cases for plaintiffs and defendants in business and commercial disputes, personal injury matters, and medical malpractice cases.

He began serving as a neutral in 1987 as a volunteer settlement panelist for the California Superior Court and has practiced privately as Ashworth ADR Solutions since 1990. He sits as a mediator, sole arbitrator, member of three-arbitrator panels, and neutral settlement officer, and has served as a discovery referee by Superior Court appointment. His neutral work includes personal injury, medical malpractice, business, and real estate disputes; uninsured and underinsured motorist arbitrations; and Song-Beverly Consumer Warranty Act (Lemon Law) matters.

Most of his appointments come from attorneys who know him from trial or have appeared before him as a neutral, and who bring him the cases they could not settle on their own.

$400 per hour for arbitration and mediation, with a four-hour minimum. The same rate applies in person or by videoconference.

The four-hour minimum is billed in advance and is due ten days before the hearing. All fees must be paid before an arbitration award is served. Payment is by check, payable to Mark S. Ashworth, APC. The engagement is directly with the attorneys of record.

Fees are non-refundable if a hearing is cancelled within three days of the scheduled date.
